Please read through the terms and conditions below before enrolling, booking any classes or purchasing any packages, membership, workshops, training and events. When enrolling, booking any classes, and/or purchasing any packages, membership, workshops, events of Pragya Yog School Limited (“PYS”), you agree to the terms and conditions listed below:
- These are the terms and conditions for all packages, membership, classes, workshops, training and events of PYS. These terms and conditions are valid regardless of whether the packages, membership, classes, workshops, training and events have been purchased, gifted or bought using a gift voucher.
- All packages and membership (collectively the “Packages”) validity starts from the date of the first class you attend.
- Packages shall expire at the end of the period stated in your online account. Any sessions not used by the expiry date may not be used, redeemed or refunded.
- Payment must be made upon booking. You will not be permitted to sign-up for a class, workshop, training or event (collectively “Classes”) as unpaid.
- All monies paid are non-refundable. No refund of any payment made shall be given to you under any circumstances.
- Packages and Classes cannot be transferred, shared, sold or assigned to anyone.
- Packages and Classes purchased cannot be exchanged for any other packages, membership, credits or Classes.
- PYS reserves the right to change the Packages subscription plan or adjust pricing for our service or Classes or any components thereof in any manner and at any time as PYS may determine in their sole and absolute discretion. Any changes, including price changes, to Classes and Packages will take effect following notice to you.
- PYS reserves the rights in the arrangement of all Classes. The Class details listed on the description page and website are subject to change should circumstances require. Please check with us before purchase if you have any question.
- PYS reserves the right to change the schedule for any Classes, course dates, class types or instructors without any notice.
- PYS reserves the right to cancel any regular group class if bookings are fewer than 3 students.
- You must adhere to the code of conduct listed below. If the code of conduct is not followed or if PYS is in the reasonable opinion that your conduct may be harmful to the interest of PYS or to other users of PYS, PYS reserves the right to (i) expel you from the studio; (ii) terminate your Packages; (iii) refuse the purchase of any future Packages and Classes; (iv) refuse your attendance of any Classes. If you have been expelled or refused under this Clause, any unused portion of the Packages or credits will not be refunded.
- PYS shall be entitled to terminate this agreement if you fail to pay monthly fees or any fees for any Classes you enrolled by giving 1 month’s written notice to you. Such termination shall not affect the right of PYS to recover the unpaid fees and interests and related costs and all expenses.
- PYS reserves the right to refuse entry.
- Any suspension of Packages must be applied for in writing to admin@pyshk.com supported by any valid proof, such as medical certificate or air tickets. It must be applied for in advance by giving at least 14 days’ notice.
- You understand and agree once the suspension is approved you cannot change, modify, extend and cancel the suspension period.
- You understand and agree that you will be charged HK$500 admin fee for any approved suspension. You understand and agree that suspension will be processed upon approval and payment of the admin fee.
- Your absence or failure to attend the classes, workshops, training and events or avail the services for any reason will not relieve you from the obligation to pay the monthly dues or any relevant fees.
- You understand and agree that you are not permitted to cancel your Packages before expiry of your Packages.
- PYS reserves the right to change the dates, time, syllabus, structure, content or trainer(s) of any teacher training courses, workshops and events (“Event”) and reserves the right to conduct any parts of the Event online.
- If you choose to leave any Event; not attend classes without any written notice and prior approval from management; fail to complete the practical assessment or assignment on or before the deadline set (if any); you will be considered to have dropped out from the Event and will not be eligible to receive the certification (if applicable).
- Any private and group private classes, teachers are assigned and confirmed based on their availability. You will have to cancel at least 24 hours before the start time of your private or group private class. Less than 24 hours’ notice will be considered late cancellation, and your package will be deducted.
- Bookings and cancellations for Classes shall be done via your account at our website, www.pyshk.com.
- Regular group class bookings can be made 4 days in advance and booking closes 4 hours before the scheduled class. It is important you book your class in advance.
- Each regular group class requires a minimum of 3 students. You will be notified 6 hours before the scheduled class if it is cancelled.
- Cancellations must be made 8 hours before the start of the scheduled class.
- Any cancellation done less than 8 hours prior to the start of the class is considered a late cancellation.
- Any late cancellation or no show for a class already booked:
- Students with Credit Package and 8 Classes/Month Membership: will result in the deduction of that 1- class credit from your account.
- Unlimited Membership: more than 3 late cancellations/no-shows within 1 month will result in suspension of online booking privileges for one week.
- Class arrangements during typhoons and black rainstorm warnings:
- If Typhoon Signal No. 8 or above is hoisted or will be hoisted as announced by the Hong Kong Observatory or in force before or during class, the class will be cancelled.
- If black rainstorm warning is issued before class, the class will be cancelled.
- If the Black Rainstorm is issued during the class, the class will continue as usual.
- If (i) Typhoon Signal No. 8 or above or (ii) a black rainstorm warning is lowered 2 hours before the class, the class will continue as usual.
- Code of Conduct
- Please arrive 10 minutes before class starts.
- Please take off your shoes before entering the studio.
- Please leave your bags in the storage space and lockers provided.
- Please leave all mobile devices on silent either in the storage space or lockers provided
- If you arrive at the studio and there is a class in progress, please keep your voices low and wait in the waiting area to avoid disrupting the class.
- You shall be careful of your own personal safety during practice and you agree not to endanger the safety of other students. Be respectful of other people’s belongings and avoid walking on other people’s mats.
- Be respectful of the equipment supplied by PYS and clean all used mats and props at the end of each session with cleaning products provided.
- No food is allowed in the practice area.
Participation Terms and Liability Waiver
- You fully understand that you are engaging in physical exercise, including the use of facilities and instructions by PYS’s personnel. You fully understand and acknowledge that all exercise (“Exercise”), including all physical and bodily positions, movements, activities and exertions, during our Classes involves a risk of personal injury. You acknowledge and agree that it is entirely your own choice whether to perform Exercise under the guidance of our instructors and undertake to listen to and follow the instructions of our instructors attentively before, during and after any Exercise during our Classes at all times. You must never attempt any Exercise beyond the degree of exertion and difficulty which you are able to manage comfortably without incurring risk of injury. You will take full responsibility for your own health and well-being while attending our Classes. It is further agreed that PYS and our instructors will not perform any evaluation of your physical condition prior to your starting or continuing the Exercise and/or Classes. Your practice outside our Classes is entirely at your own risk.
- We will not be responsible for any injury or damage (whether self-inflicted, caused by us or any third party or by any other means) that you may suffer while attending our Classes. You are encouraged to take out insurance if you have any concerns.
- You hereby warrant, represent and agree that you are in proper physical and mental condition to participate in our Classes and have no physical disability, impairment, or ailment preventing you from engaging in any Exercise or attending our Classes, or that will be detrimental to your health, safety, comfort or physical condition, or that of others. You are advised to consult a licensed General Practitioner regarding your ability to participate in physical activities, Classes and/or use of our equipment and facilities and the physical activities undertaken at PYS and the use of our equipment and facilities imposes physical demands upon you.
- You must inform us at the earliest opportunity (in any event before any Classes) if you are suffering or have recently suffered from any medical or physical condition, injury or disability that might make you more susceptible to risk of injury when performing any Exercise and/or attending any Classes.
- You agree to stop performing Exercise immediately (or otherwise continue to perform Exercise at your own risk) during our Classes if (i) you feel or experience any signs of pain or discomfort; (ii) you are not willing to accept the degree of risk of injury that might be associated with any particular Exercise; or (iii) you have been instructed to stop.
- You hereby agree to waive all claims or rights you might otherwise have against PYS including the right to sue PYS, its employees or agents, for any injuries or claims aforesaid.
- You have carefully read this agreement, waiver and release and fully understand this is a release of any and all future claims against PYS for any injury or risk of injury resulting from activities while attending PYS facilities and Classes.
- The use of the facilities at PYS and attendance of any Classes naturally involve the risk of injury to yourself or other participants, members or guests, whether caused by you or someone else. You understand and voluntarily accept the risk. You warrant and represent that you have consulted with your licensed General Practitioner prior to beginning any exercise program and Classes. You agree that PYS will not be liable for any injury including, without limitation, personal, bodily, or mental injury, economic loss, or any damage to you, or your relatives resulting from the acts of anyone using the facilities or acts of PYS’ employees or agents. You agree to bear all responsibilities for all liabilities or damages arising from any injury, including, without limitation, bodily or mental injury, economic loss, or any damage to another participant, member and/or personnel caused by your deliberate or negligent action. If any claim is made by anyone based on any injury, loss or damage described here, which involves you or your guest, you agree to (i) defend PYS against such claims and pay PYS for all expenses, including legal fees relating to the claim and (ii) indemnify PYS for all liabilities to you and your spouse, unborn child, relatives or anyone else resulting from such claims.
- You further agree to release PYS from any liability for any loss or theft of personal property.
- PYS is not responsible for keeping any items lost or stolen on its premises for any reason whatsoever. You are responsible for safekeeping your personal belongings on the premises and agree to release PYS from any liability for any loss or theft of personal property.
- You grant your permission to us and any transferee or licensee or any of them, to utilise any photographs, motion pictures, video recordings and other references or records of our Classes which may depict, record or refer to you for any purpose (“Likeness”), including commercial use by us, our sponsors and our licensees. This permission is for use anywhere in the world, on the Internet and social media platforms and for an unlimited period of time. You understand and agree that you will not be compensated or receive additional consideration for consenting to the use of your Likeness and that you will not be given a chance to receive, inspect or approve the promotional or marketing material, messages and/or content that may use your Likeness.
- You agree that these terms and conditions should continue to have effect to the maximum extent as permitted under the laws. If any section of this agreement is determined by any court or other competent authority to be unlawful and/or unenforceable, you agree that only the relevant part of such section that is so determined to be unlawful and/or unenforceable should be struck out and severed from the remainder of the section and that all other sections of this agreement continue in effect.
- By agreeing to this agreement, you acknowledge your understanding and acceptance of the rights and obligations of PYS. You agree to comply with the rules of PYS and such rules are posted and/or otherwise available at PYS studio. PYS reserves the right to amend its rules from time to time and where appropriate. You shall ask us for clarification of any question or concerns prior to agreeing to this agreement.
- In this agreement, “we” means (and “us” and “our” refer to) Pragya Yog School Limited, a limited liability company incorporated in Hong Kong.
- This agreement shall be governed by and construed in accordance with the laws of the Special Administrative Region of Hong Kong, and any disputes relating to this agreement, or our Classes will be subject to the exclusive jurisdiction of the courts of the Special Administrative Region of Hong Kong.
